Quick answer: A relieving letter is the document you give a departing employee in India confirming that you accepted the resignation and released them on a stated date. No general statute obliges you to issue one. Even so, Indian employers routinely ask for it before a new joiner starts, so it works as a passport between jobs.
- A relieving letter is customary, not a general statutory duty for office staff.
- The Bombay High Court held in 2026 that an employer can decline one where it reasonably refused a resignation.
- Where the Model Standing Orders, 2026 apply, workers get a service certificate within ten days of exit.
- Final wages are due within two working days of the last day, before the letter normally goes out.
Why do Indian employers ask for a relieving letter?
Because it proves the person left cleanly. Notice served. No dispute pending.
Foreign hiring managers often miss this.
Many Indian offer letters make joining conditional on a relieving letter from the last employer. Your own relieving letter meaning in practice is simple: a short note on letterhead stating the name, employee ID, role, last working day and that the resignation was accepted.
| Relieving letter | Experience letter | |
|---|---|---|
| Purpose | Confirms release from duty | Confirms role and tenure |
| Timing | On or after the last day | At exit, or on request later |
| Usual content | Resignation accepted, last day, dues cleared | Designation, dates, sometimes conduct |
| Legal duty | No general duty | No general duty, with exceptions |
Some employers merge the two into one letter. Fine.
The combined version still needs explicit release wording. A background check at the next employer will look for “relieved from duty” and an exact date, and a vague line can stall the hire. See experience letter for the other half of the relieving letter vs experience letter question.
Can an employer refuse to issue a relieving letter?
Sometimes, yes. The Bombay High Court ruled on this in Bharat Aviation v Rahul Soni (2026), as reported in CMS IndusLaw’s employment newsletter. An employer could not be forced to issue the letter where it had reasonably refused a resignation that breached a valid training bond.
That said, the case turned on a bond and an unaccepted resignation. Withholding the letter only to pressure someone over a disputed recovery is a different matter, and it invites a claim. Pay the full and final settlement first, then issue the letter.
When should the letter go out?
On the last working day, or as soon as dues clear. A late letter can cost your former employee their next job.
How does Remunance issue relieving letters for your India team?
Remunance issues relieving and experience letters on our own letterhead as the legal employer, once the notice period ends and the final settlement is paid. Our offboarding runs asset recovery and the PF exit before the letter goes out. Each step is mapped in our employee offboarding process guide. For exits that leave no loose ends, book a call with our offboarding team.
What else do people ask about relieving letters?
Is a relieving letter mandatory in India?
Not under any general statute for office staff. It is a strong market convention, and most Indian employers will not onboard a mid-career hire without one.
Can I join a new company without a relieving letter?
Often, if the new employer accepts alternatives such as an accepted resignation email, the final payslip and the employee offboarding clearance.
How long does it take to get a relieving letter?
A few days at most. Delays generally trace back to unsettled dues or unreturned assets.
