What is a probation period in India?

Quick answer: A probation period is the trial stretch at the start of a job when you test fit before confirming the hire. In India no statute fixes its length for managers or office staff, so the appointment letter sets it. For workers covered by standing orders, the Model Standing Orders, 2026 list “probationer” as a distinct category.

  • Probation length for non-workers is a matter of contract and company policy.
  • The Model Standing Orders, 2026, notified on 8 May 2026, name seven worker categories, including probationer.
  • EPF, ESI and timely wages apply from day one.
  • Final wages are due within two working days of exit, even for a probationer let go in week three.

How do probation rules work in India in 2026?

Two regimes run side by side. The test is simple. It turns on whether the person is a “worker” under the Industrial Relations Code.

WhoWhere probation rules come from
Managers, administrators, supervisors above ₹18,000 a monthThe appointment letter and HR policy
Workers in establishments with 300+ workersCertified standing orders
Workers where the Model Standing Orders apply by defaultSix months, extendable by up to three on assessment

The six-month default comes from the Model Standing Orders as summarised in JSA’s May 2026 employment alert.

Most foreign-owned tech teams sit in the first row. So your probation rules are what you write down.

Market practice settles on three to six months for salaried roles, with longer stretches for senior hires whose impact takes a full planning cycle to judge.

Can you end employment during probation?

Yes, on the notice your letter sets. That said, a probationer is still an employee with full statutory rights, so wages, PF, leave already earned and the exit paperwork all follow the normal rules.

Two traps.

First, silence at the end of the term. If the letter does not say what happens when probation expires, a long-serving probationer may argue confirmation by conduct. State the outcome: confirmation in writing, extension in writing, or exit.

Second, misconduct dressed as poor fit. If you dismiss for misconduct, follow fair process even during probation, as the termination of employment rules still bite.

Let’s say a Pune analyst on six months’ probation has a one-week probation period notice clause. You can end it in month four with a week’s pay in lieu. Quick and lawful. You still cannot skip the final settlement or the PF exit entry.
