What is termination of employment in India?

Quick answer: Termination of employment is the employer ending a person’s job. In India, the reason decides the rules. Dismissal for misconduct needs a fair inquiry. Ending a “worker’s” job for any other reason is usually retrenchment under the Industrial Relations Code, 2020, which carries notice and compensation duties.

  • The IR Code replaced the Industrial Disputes Act, 1947 on 21 November 2025.
  • Retrenchment of a worker with a year’s service needs one month’s notice and 15 days’ average pay per completed year.
  • Industrial establishments with 300 or more workers need prior government permission to retrench.
  • Final wages are due within two working days of exit under the Code on Wages, 2019.

What are the types of termination in India?

Four routes, each with a different legal path. Picking the wrong label is the commonest error.

RouteWhat the law expects
Dismissal for misconductWritten charge, a chance to reply, an inquiry, a reasoned order
RetrenchmentNotice, compensation, the Re-skilling Fund payment
End of a fixed term or non-renewalContract terms, and not retrenchment under the IR Code
Termination of a manager under contractContractual notice and fair dealing

Voluntary retirement, superannuation and continued ill-health also fall outside the retrenchment definition in section 2 of the IR Code. Everything else counts.

So a “role redundancy” email to a non-managerial engineer is retrenchment in law, whatever HR calls it. The notice, the 15 days’ pay per year and the Worker Re-skilling Fund deposit all follow.

What due process does Indian law require?

A fair hearing before a misconduct dismissal. That is the core of the termination rules India courts apply.

Where standing orders apply, they spell out the process. Under the Model Standing Orders, 2026, an inquiry should ordinarily finish within 90 days of suspension, and the worker can appeal within 21 days. Suspended workers get 50% of wages for the first 90 days.

Managers fall outside the “worker” definition. Their exit runs on the contract. Even so, a clear reason, a documented review and the contractual notice period protect you if the person later sues.

What do foreign employers get wrong?

They import at-will habits. A US manager tells a Pune engineer on a video call that today is the last day, with no notice, no letter and no settlement plan.

That single call can create three problems: a wrongful termination claim, a missed two-working-day wage deadline and a team that loses trust. India reads exits closely. Our story on termination in a global team shows how that plays out.

How does Remunance handle terminations for your India team?

Remunance is the legal employer, so we issue the notice, run any inquiry, compute dues and pay the full and final settlement on time. We then close PF, insurance and the employee offboarding checklist. Our guide to termination in India covers each route in depth. What else do people ask about termination in India?

Can an employer terminate without notice in India?

Only for proven misconduct after a fair inquiry, or where the contract allows pay in lieu. Otherwise give the notice the contract or the IR Code requires.

Is termination the same as retrenchment?

They overlap. Retrenchment is one kind of termination: ending a worker’s service for any reason except disciplinary action, retirement, contract expiry or ill-health.

What does termination mean on an Indian experience letter?

Usually nothing. Most employers state only the dates and role, and leave the reason for exit off the letter unless the employee asks for it.
