Quick answer: Variable pay is the part of an Indian salary that depends on performance, usually an annual or quarterly bonus. It is often folded into CTC and taxed as salary when paid, with TDS under section 392 of the Income-tax Act, 2025. It is separate from statutory bonus under the Code on Wages, 2019, which is a legal minimum.
- Labour Ministry FAQs dated 30 December 2025 say performance-based incentives sit outside “wages” for PF and gratuity.
- Statutory bonus applies only where wages are up to ₹21,000 a month, under ceilings notified on 25 August 2026.
- Statutory bonus runs from 8.33% to 20% and must be paid within 8 months of the accounting year-end.
- Variable pay is fully taxable under both tax regimes.
How is variable pay shown in an Indian CTC?
Usually as a target on top of fixed pay. Suppose your Pune engineer has a fixed CTC of ₹18 lakh, plus a 10% target bonus of ₹1,80,000. The offer may say “₹19.8 lakh CTC”.
That headline worries candidates. Indian hires discount it fast, because the variable part depends on ratings they don’t yet control.
So split it in writing. Show fixed CTC, target variable and the payout rule as three lines. Tie the payout to your performance appraisal calendar so nobody argues about timing later.
How is a performance bonus taxed?
As salary, in the month it is paid. Let’s say the engineer scores 80% and receives ₹1,44,000.
| Line | Amount |
|---|---|
| Bonus paid | ₹1,44,000 |
| Taxable income before bonus, new regime | ₹16,44,643 |
| Taxable income after bonus | ₹17,88,643 |
| Extra tax at 20% plus 4% cess | ₹29,952 |
| Bonus in hand | ₹1,14,048 |
Both figures sit inside the 20% slab. A payout big enough to push taxable income past ₹20 lakh would pay 25% on the slice above, and 30% beyond ₹24 lakh, so senior hires feel a sharper bite.
Payroll usually takes the extra TDS in the payout month. Lumpy, but correct. Our guide on how to calculate a salary raise percentage helps when you mix bonus and increments.
How is variable pay different from statutory bonus?
One is your choice. The other is the law.
Statutory bonus covers employees earning wages of ₹21,000 a month or less. It runs from 8.33% to 20%, calculated on ₹7,000 a month or the minimum wage, whichever is higher. SCC Online’s note on the August 2026 notifications has the detail. Your engineer is far above that line. So only contractual pay applies.
On labour law, the Ministry FAQs summarised by SCC Online treat performance incentives as outside wages. But FAQs are guidance. The Code’s text prevails. A “variable” amount paid to everyone, every month, at a fixed figure looks like wages.
A joining bonus is different again: a one-off payment, usually with a clawback.
How does Remunance pay variable pay for your India team?
You set the rules. You approve each payout. Remunance, as the legal employer, runs it through Indian payroll, deducts TDS and reports it on the annual salary TDS certificate. Statutory bonus for eligible staff is handled separately, on the legal timeline. The money passes through at cost. No percentage fee. What else do people ask about variable pay?
Is variable pay part of CTC?
Often, yes. Many Indian employers include the target variable in CTC, which is why candidates ask for “fixed CTC” separately.
Is variable pay counted for PF and gratuity?
Usually not. Ministry FAQs treat performance-based incentives as outside wages, but a fixed monthly amount labelled “variable” may still count.
Is variable pay guaranteed in India?
No, unless the contract says so. Payout depends on the rules in the offer letter or bonus policy, so write them down clearly.
