Quick answer: A joining bonus is a one-time payment you make when a new hire joins, usually with the first or second salary. Indian employers use it to cover a candidate’s notice buyout or forfeited variable pay. It is taxed as salary, with TDS. Many offers add a clawback if the hire leaves within 12 months.
- A joining bonus is taxable as salary in the year it is paid, with TDS through payroll.
- Deductions from wages must fit a purpose listed in section 18 of the Code on Wages, 2019.
- Total deductions in a wage period cannot exceed 50% of wages under section 18(3).
- Under section 74 of the Indian Contract Act, 1872, a court awards only reasonable compensation, capped at the sum named.
Why do Indian employers pay a joining bonus?
To close the gap a move creates. Two gaps are common.
The first is the notice period. Many Indian tech contracts carry long notice, and a notice period buyout can run to two months’ pay. The second is money left behind, such as an annual variable payout due weeks after the candidate resigns.
A one-time sum fixes both. Your fixed salary stays clean for next year’s revision, and the bonus sits outside the recurring cost to company figure in the offer letter. Our guide to salary structure in India shows where it fits.
It also guards against offer dropout. Cash on day one is hard to walk away from.
How is a joining bonus taxed and clawed back?
It is taxed like salary in the month you pay it, and a clawback recovers part of it if the hire walks out before the agreed period ends.
Let’s say you hire a Hyderabad product manager on ₹30 lakh a year with a ₹3,00,000 joining bonus. Her income already sits in the 30% slab of the new regime.
| Item | Amount |
|---|---|
| Joining bonus paid with the first salary | ₹3,00,000 |
| Extra tax at 30% plus 4% cess | ₹93,600 |
| What she keeps | ₹2,06,400 |
| Pro-rata clawback if she leaves after 5 of 12 months | ₹1,75,000 |
Notice the trap. The clawback runs on the gross ₹3,00,000, but she only ever banked ₹2,06,400, so a pro-rata claim after month one would be ₹2,75,000. State in the letter that recovery is on the gross amount. Disputes shrink.
Can you deduct the clawback from her final salary?
Partly, at best. Under section 18 of the Code on Wages, deductions must fit a listed purpose and stay within 50% of wages in a wage period. So the full sum rarely comes out of the full and final settlement.
The rest becomes a contract claim. Section 74 of the Indian Contract Act limits you to reasonable compensation, not exceeding the sum named. A pro-rata clause is easier to justify than a demand for the whole bonus after month eleven.
Who pays a joining bonus under an EOR?
The EOR pays it through Indian payroll and bills you at cost.
You set the terms. The EOR writes them into the appointment letter, deducts TDS and shows the bonus on the payslip. If the hire leaves early, the EOR applies the clawback within the deduction limits and tells you exactly how much remains unrecovered and why.
How does Remunance pay joining bonuses for your India hires?
Remunance writes your joining bonus and clawback into the appointment letter, then pays it through payroll with TDS and passes the cost through without markup. Onboarding takes as little as 2 working days from a signed contract, so the bonus lands with the first salary. Our guide to hiring employees in India explains the offer stage. What else do people ask about joining bonuses?
What is the joining bonus meaning in an offer letter?
It is a one-time sum promised for joining, separate from fixed salary, and the letter should state the amount, the payment month and any clawback period in writing.
Is a joining bonus part of CTC?
It depends. Many Indian offers show it as a one-time line outside the annual CTC, so next year’s salary revision ignores it.
Is a joining bonus clawback legal in India?
Yes, if the contract states it clearly and the sum is reasonable. Recovery from wages is limited by the Code on Wages, and anything beyond that is a contract claim.
