What is offer dropout in India?

Quick answer: Offer dropout happens when a candidate accepts your job offer but never joins. In India the gap between acceptance and day one can run two to three months because of contractual notice periods, so counter offers and rival offers have time to land. No Indian law forces a candidate to join, so your defence is process, not litigation.

  • An accepted offer letter is a contract, but courts will not force a person to work for you.
  • Damages for breach are limited to reasonable compensation under sections 73 and 74 of the Indian Contract Act, 1872.
  • PF, ESI and payroll duties start only when the person joins, so a pre-joining dropout leaves no statutory dues.
  • Your offer dropout rate is the share of accepted offers that never reach day one.

Why do candidates drop out after accepting in India?

Because the wait is long and the market keeps calling. Three causes repeat.

Notice comes first. A candidate who resigns on day one of a 90-day notice period sits in the market for three months. Recruiters keep calling throughout.

The second is the counter-offer. Their current employer now knows your number and can beat it.

The third is offer shopping. Some candidates accept one offer while holding others, and Remunance’s recruitment head describes that pattern in a reality check on Indian job market commitment.

When an employer withdraws an accepted offer, the term is usually offer renege. That damages your employer brand faster than any candidate dropout.

How do you measure and cut offer dropout?

Track one ratio, then attack the waiting period.

Your rate is simple. Let’s say you made 40 accepted offers last quarter and 6 people never joined. Your dropout rate is 6 ÷ 40, or 15%. Compare each team’s figure with its own past quarters, not with numbers from a vendor slide.

Then work the gap between acceptance and joining.

  1. Shorten it. Ask about early release and price a joining bonus to fund a buyout.
  2. Pay at the market, using salary benchmarking before you name a figure.
  3. Issue the formal letter within a day of the verbal yes.
  4. Keep weekly contact. Send the laptop and a welcome note before day one.
  5. Hold a warm second choice for every critical role.
  6. Run background checks in parallel, not after the notice period ends.

Can you claim damages from a candidate who never joins?

In theory, yes. In practice, rarely. Section 73 of the Indian Contract Act covers only losses that arise naturally from the breach, and section 74 caps any named sum at reasonable compensation. Recruiting fees are hard to prove as loss.

How does offer dropout play out under an EOR?

The EOR carries the paperwork. You carry the hiring risk.

The EOR issues the offer and appointment letters as legal employer, so ask it how quickly it can do so. If a candidate drops out before joining, no payroll has started and no employment cost should arise. Check your EOR contract for any fee on unused onboarding.

How does Remunance reduce offer dropout for your India hires?

Remunance bundles talent acquisition, background verification and laptop provisioning, so the hire gets letters, checks and equipment before day one. Onboarding can finish in as little as 2 working days from a signed contract. See how we run recruitment services in India, and ask us to review your offer-to-joining process.

What else do people ask about offer dropout?

What is a normal offer decline rate in India?

There is no official figure. Rates vary by role, seniority and notice length, so track your own rate each quarter and compare teams against themselves.

Is it illegal to back out of a job offer in India?

No. Backing out is a breach of contract at most. Courts will not order someone to join, and damages are limited to provable, reasonable loss.

Can an employer withdraw an accepted offer?

Yes, but it carries legal and reputational risk. If the candidate resigned elsewhere relying on your offer, they may claim compensation for the loss.
