- An Indian freelancer selling to a foreign client can zero-rate the invoice if all five export conditions in section 2(6) of the IGST Act are met.
- CBIC accepts rupee payments through RBI-permitted Special Vostro accounts as meeting the payment condition.
- Banks now issue an e-FIRA linked to the export record, while physical FIRCs mostly cover capital receipts.
- From 1 October 2026, the freelancer must realise export proceeds within 9 months of the invoice.

How is a freelancer different from an independent contractor or gig worker?
Mostly in pattern. The legal category is the same.
A freelancer is an independent contractor who usually works on short, defined projects for many clients. A longer, exclusive contractor arrangement drifts toward employment. A gig worker under the Code on Social Security is different again, because the work is typically matched through a platform or aggregator.
That pattern matters for risk. A designer who invoices five clients a month is plainly in business. A “freelancer” who has billed only you for two years, on fixed hours, looks like staff.
What happens when you pay an Indian freelancer from abroad?
The money arrives as an export of services, and three records follow it: the bank’s advice, the freelancer’s GST position and the RBI realisation clock.
| Step | Who handles it | What to know |
|---|---|---|
| You pay in USD, GBP or EUR | You | Pay against a numbered invoice, with a clear payment reference |
| Bank credits the freelancer | Freelancer’s AD bank | Issues an e-FIRA or FIRC as proof of foreign inward remittance |
| Invoice treated as export | Freelancer | Zero-rated under section 16 of the IGST Act, often under a Letter of Undertaking |
| Proceeds realised | Freelancer | Within 9 months of the invoice, or 12 months if invoiced in rupees |
CBIC Circular 202/14/2023-GST restates the five conditions. The supplier sits in India, and the recipient and place of supply sit outside it. Payment comes in convertible foreign exchange or RBI-permitted rupees, and the two parties are not establishments of one person. The realisation period comes from the RBI’s FEMA export regulations, 2026.
The FIRC or e-FIRA is the freelancer’s document. Still, a clear invoice from them and a payment reference from you make their refund claim easier, and good freelancers notice.
When should you stop hiring someone as a freelancer?
When they work only for you, on your schedule, for months at a stretch.
At that point, the contractor of record route or direct contracts no longer fit the facts. Move the person onto employment terms through an EOR. Our guides on how to pay contractors and the tax implications of hiring contractors vs employees set out the cost trade-off.
How does Remunance help when a freelancer becomes a core hire?
Remunance runs independent contractor engagement and compliance for genuine freelancers, then converts the right ones to EOR employment with PF, gratuity and benefits administration from day one. We hold ISO/IEC 27001:2022 certification, so their work data and your IP sit under audited controls. If your best freelancer has quietly become a full-time colleague, talk to us about converting them.
What else do people ask about freelancers in India?
Can I hire freelancers in India without an Indian company?
Yes. You can contract and pay an Indian freelancer directly from abroad. The freelancer handles their own income tax and any GST.
Do Indian freelancers charge GST to foreign clients?
Usually not. If the export conditions are met, they can invoice at zero rate under a Letter of Undertaking or pay IGST and claim a refund.
Is a freelancer entitled to PF or gratuity?
No. Freelancers are self-employed. PF, ESI and gratuity attach only to employees.
