What is moonlighting, and is it legal in India?

Quick answer: Moonlighting is taking paid work on the side, such as freelance projects, consulting or a second job, while holding a regular job. India has no general statutory ban. The OSH Code, 2020 restricts double employment only in factories and mines, so for office roles the employment contract and the Model Standing Orders, 2026 set the limits.

  • No central law prohibits moonlighting by private-sector office employees.
  • Section 30 of the OSH Code bars similar work in a factory or mine within 12 hours of a previous shift.
  • The Model Standing Orders, 2026 include an exclusive-service clause, applied where no certified standing orders exist.
  • Exclusivity during employment can be enforced, while non-competes after exit are void under section 27 of the Indian Contract Act.

How is moonlighting different from dual employment?

By scale and secrecy. Moonlighting usually means small, part-time side work. Dual employment means two full-time jobs at once, typically hidden.

The line matters for your response. A product designer who teaches a weekend course is moonlighting. A developer who quietly holds a second full-time role with a rival is in breach of almost any Indian offer letter. Treat the two differently. Otherwise, a blanket ban simply pushes people to hide harmless side work from you, and the risky cases go unnoticed along with the harmless ones.

What should a moonlighting policy in India cover?

Three clauses, written plainly into the employment contract and the handbook.

ClauseWhat it saysWhy it holds up
Exclusivity with a disclosure routeNo other employment without written approval, and approval is not withheld unreasonablyIn-term covenants are generally enforceable
Conflict and confidentialityNo work for competitors or clients, and no use of employer data or toolsBacked by an NDA and confidentiality duties
IP ownershipWork made in the course of employment belongs to the employerSection 17 of the Copyright Act, 1957 vests it in the employer unless agreed otherwise

The enforceability column rests on Niranjan Shankar Golikari v Century Spinning, where the Supreme Court upheld a covenant against working for others during the contract term. After exit, the position reverses. A non-compete clause running past the last day cannot be enforced.

Watch the IP edge. Section 17 gives you work made “in the course of” employment. A side project built at night on a personal laptop may fall outside that phrase. So spell out the scope in your IP assignment clause, and decide before a dispute does it for you.

Can you dismiss an employee in India for moonlighting?

Yes, if it breaches a clear clause and you follow due process. Issue a show-cause notice, hear the explanation and decide in proportion.

Undisclosed work for a competitor, or misuse of company data and tools on a side project, usually justifies dismissal after a fair inquiry. A disclosed weekend hobby rarely does. For the industry debate, read our piece on what companies and experts think about moonlighting.

What else do people ask about moonlighting?

What does moonlighting mean at work?

It means doing paid work for someone else outside your main job, usually after hours or at weekends.

Is moonlighting a crime in India?

No.

At most it is a breach of contract or misconduct under your standing orders, unless it involves theft of data or fraud.

Can employees in India freelance on weekends?

Yes, unless the contract bars it or the work conflicts with the employer’s business. The safest route is written disclosure and approval.
