Quick answer: An exit interview is a structured conversation with a departing employee about why they are leaving and what would have kept them. No Indian law requires one. But it sits inside a tight legal window, because the Code on Wages makes final wages payable within two working days of the exit, interview or not.
- Exit interviews are voluntary for both sides in India.
- Final wages cannot be held back because an employee skipped the interview.
- Interview notes are personal data under the DPDP Act, 2023.
- The best timing is the last week of the notice period, after the handover.
Which exit interview questions actually get useful answers?
Questions about specifics work. Questions about feelings get polite answers.
| Question | What it tells you |
|---|---|
| When did you first start looking? | The trigger event, often a review or a manager change |
| What would have made you stay? | Whether a counter-offer could have worked |
| How did your pay compare with the offer you accepted? | Whether your bands are behind the market |
| Did you have the tools and access you needed? | Gaps in IT and support |
| How clear were your goals and reviews? | The quality of your appraisal cycle |
| Would you come back, or refer a friend? | A simple alumni and brand score |
Keep it to 20 or 30 minutes. Six good questions beat twenty.
When should an exit interview happen in an Indian exit?
In the final week, after the handover is signed and before the last working day. Put it on your offboarding checklist with a date.
Earlier, the employee may still be negotiating. Later, they have no reason to show up. And once they leave, the clock has started: section 17(2) of the Code on Wages on India Code requires final wages within two working days.
So never link the two. “Attend the exit interview, then we release your full and final settlement” is a request you cannot enforce. Run the interview, recover the laptop through your asset recovery process, and pay on time. Three separate tracks.
Who should run it?
Not the direct manager. People speak more freely to HR or to someone outside the reporting line.
What happens to exit interview notes under the DPDP Act?
They are personal data, so your duties under the Digital Personal Data Protection Act, 2023 apply to them.
Section 8(7) of the DPDP Act as published by MeitY requires erasure once the purpose is served, unless a law requires you to keep the data. Most of those duties start on 13 May 2027 under the DPDP Rules.
The practical fix is simple. Store themes, not quotes, in your reporting. Delete named transcripts on a fixed schedule.
How does Remunance run exit interviews for your India team?
Offboarding is bundled with Remunance’s employer of record service, so the exit conversation fits into a sequence we already run, and the F&F goes out inside the statutory window whatever the interview brings. Because we are the legal employer, the conversation can sit outside the reporting line. It slots into our employee offboarding process alongside asset return and letters. To hear why your India team leaves, talk to our HR team about structured exits.
What else do people ask about exit interviews?
Is an exit interview mandatory in India?
No. Neither the employer nor the employee is legally required to hold one. It is a policy choice.
Can an employee refuse an exit interview?
Yes. Refusing has no effect on final wages, gratuity or the relieving letter, all of which the employee is owed regardless.
What should you not say in an exit interview?
Employees are usually advised to avoid personal criticism of colleagues. Employers should avoid promises about references or rehiring they cannot keep, and anything that sounds like pressure to withdraw a complaint.
