Quick answer: DPIIT recognition is the Government of India’s formal recognition of an entity as a startup under the Startup India programme. Since G.S.R. 108(E) of 4 February 2026, an entity qualifies for up to 10 years from incorporation with turnover up to ₹200 crore in every year. Recognition unlocks labour self-certification, patent rebates and the route to a tax holiday.
- Deep tech startups qualify for up to 20 years from incorporation, with turnover up to ₹300 crore.
- Eligible entities are private limited companies, LLPs, registered partnership firms and, since 2026, cooperative societies.
- More than 2.23 lakh startups were recognised by 31 March 2026, including over 55,200 in FY 2025-26.
- Angel tax under section 56(2)(viib) is not applicable from AY 2025-26, after the Finance (No. 2) Act, 2024.
What changed in the 2026 startup definition?
The turnover cap doubled, and deep tech got its own lane. A big shift.
| Test | Old definition (2019) | From 4 February 2026 |
|---|---|---|
| Age limit | 10 years | 10 years (deep tech 20 years) |
| Turnover cap in any year | ₹100 crore | ₹200 crore (deep tech ₹300 crore) |
| Eligible entities | Company, LLP, partnership | Adds cooperative societies |
You still need an innovation story: working on a new or improved product, process or service, or a scalable business model. And the entity can’t be a split or reconstruction of an existing business.
Which DPIIT benefits matter, and which are overstated?
The tax holiday gets the headlines, but most recognised startups never get it.
Section 80-IAC gives a 100% deduction for 3 consecutive years out of the first 10. It needs a separate certificate from an inter-ministerial board. It applies only to companies and LLPs incorporated before 1 April 2030, with its own ₹100 crore turnover condition. So recognition alone is not a tax holiday.
The everyday benefits are quieter. Startup India’s recognition page lists self-certification under 6 labour laws and 3 environmental laws. Labour inspections pause for 5 years unless a complaint is verified. You also get an 80% rebate on patent filing fees and a 90-day winding up route.
Angel tax is gone for everyone. So it’s no longer a recognition perk. That changes the pitch for raising money from a foreign parent through FDI.
Can a foreign company’s Indian subsidiary get DPIIT recognition?
Yes, if the subsidiary itself meets the tests. A newly formed private limited company owned by a foreign parent can apply, provided it is not a reconstruction of an existing business.
But you need the entity first. Hiring through an EOR skips that step entirely. You get a working India team without an entity, a board or any filings of your own. Recognition can wait. For founders still deciding, our guide to starting a startup in India walks through the set-up path, and recognised startups often add ESOPs early.
Why does Remunance’s own DPIIT recognition matter to you?
Remunance is itself Startup India (DPIIT) recognised, so we know what the label does and doesn’t give a young company. We employ early India teams for founders who aren’t ready to incorporate, from a flat USD 99 per employee per month. When you are ready, we help form the entity that can apply. To size up both options, get a startup hiring plan.
What else do people ask about Startup India recognition?
How long does DPIIT recognition last?
Until the entity crosses 10 years from incorporation (20 for deep tech) or its turnover exceeds the cap in any financial year. Then it stops being a startup.
Is a DPIIT certificate the same as 80-IAC tax exemption?
No. The DPIIT certificate recognises you as a startup. The 80-IAC deduction needs a separate approval and has its own conditions.
Can an LLP get DPIIT recognition?
Yes. LLPs, private limited companies, registered partnerships and cooperative societies are all eligible if they meet the age, turnover and innovation tests.
