- Section 30 of the OSH Code stops a worker taking factory or mine work within 12 hours of similar work elsewhere.
- The Model Standing Orders, 2026 carry an exclusive-service clause.
- The Supreme Court upheld in-term exclusivity covenants in Niranjan Shankar Golikari (1967).
- An employee keeps one UAN for life, so every employer’s PF filings land under the same number.

Is dual employment legal in India?
For most office jobs, the law is silent. The contract decides.
| Situation | Legal position |
|---|---|
| Factory or mine worker takes similar work within 12 hours | Barred by section 30 of the OSH Code |
| Contract has an exclusive-service or no-other-employment clause | Breach of contract, so disciplinary action can follow |
| Model Standing Orders apply by default | Exclusive-service clause applies to covered workers |
| No exclusivity clause and no conflict of interest | No statutory bar, though confidentiality and loyalty duties still apply |
The bar in section 30 sits in the OSH Code text on India Code. The enforceability point comes from Niranjan Shankar Golikari v Century Spinning, where the Court held that negative covenants operating during employment are generally not restraints of trade.
After the job ends, the position flips. A non-compete clause that runs past the exit is void under section 27 of the Indian Contract Act, 1872.
How do employers discover dual employment?
Usually through provident fund records, and sometimes long after the fact.
The Universal Account Number follows the employee from job to job, and its service history on EPFO’s member portal lists each employer with the dates of joining and exit. Two employers filing PF for the same months leave overlapping entries. The dates give it away.
That’s why background verification at the offer stage matters. Ask for the UAN, compare the service history with the CV and resolve gaps before day one. Overlaps that surface later are harder to unwind, especially when the person already has access to code or customer data.
Remote roles raise the stakes. Suppose a developer in Pune works your US hours and a second Indian employer’s daytime hours, both on laptops at home. Neither manager sees the other job. Only the PF trail, slipping delivery or a reference check tends to reveal it.
Stay proportionate. A weekend tutor and a hidden second full-time engineer are very different cases, and the moonlighting policy should say so. Our article on what companies and experts think about moonlighting covers the debate.
How does Remunance help you prevent dual employment in an India team?
Remunance runs background verification as a bundled service before onboarding and can place an exclusive-service clause in every employment contract we issue. If a breach surfaces, we run the process and the offboarding as the legal employer. To build these checks into your next India hire, set up pre-hire verification with us.
What else do people ask about dual employment?
Can an employee work two jobs in India?
Yes, if neither contract forbids it and the work is not in a factory or mine. Many full-time offer letters do. Check the clause.
Can an employer fire an employee for dual employment?
Yes, where the contract or standing orders bar it. Treat it as misconduct, give the employee a chance to respond, and follow your disciplinary process.
Does PF show if someone has two jobs?
Often, yes. If both employers deposit PF under the same UAN for the same months, the service history shows overlapping periods.
