What is an International Worker under EPF in India?

Quick answer: An international worker epf member is a foreign passport holder on the payroll of an EPF-covered establishment in India. Indians posted to a social security agreement country also count. Foreign staff join EPF from day one and contribute 12% on full salary. The ₹25,000 wage ceiling does not apply to them.

  • The EPF and EPS Schemes, 2026 carry forward the international worker regime first introduced on 1 October 2008.
  • Nationals of a partner country who hold a home-country Certificate of Coverage under a social security agreement are excluded employees.
  • Singapore nationals contributing at home are excluded under the India-Singapore CECA.
  • Nepal and Bhutan nationals are treated as Indian employees.

How much does EPF cost for a foreign employee?

Far more than for a local hire. The 12% applies to every rupee of salary.

Let’s say you hire a US product lead in Pune on ₹3,50,000 a month. No agreement applies. Both sides pay 12%.

Foreign employee (IW)Indian employee restricted to ceiling
Employee share a month₹42,000₹3,000
Your share a month₹42,000₹3,000
Combined in a year₹10,08,000₹72,000

That money is also locked up. Many expats never expect this. An IW can withdraw the full balance only on retirement after 58 or permanent incapacity, unless covered by an SSA, per the EPFO brochure on international workers.

For staff from partner countries, the fix is usually a Social Security Agreement Certificate of Coverage. A German national on secondment who holds one stays outside Indian EPF altogether, and keeps paying into the German system instead. US nationals have no such route.

Are the IW rules still valid after the court cases?

Yes, outside Karnataka-jurisdiction cases, but the question is now before the Supreme Court.

The courts split. The Karnataka High Court struck down the IW provisions in Stone Hill Education Foundation on 25 April 2024. A Division Bench appeal is pending, with no stay.

Then the Delhi High Court upheld them in the SpiceJet and LG Electronics cases on 4 November 2025, expressly disagreeing with Karnataka.

On 12 March 2026, the Supreme Court issued notice on LG’s appeal but did not stay the Delhi ruling. Its only interim protection covers LG itself, as Cyril Amarchand Mangaldas’s alert on the Supreme Court notice explains.

So budget for full-salary PF today. If the same person also sits on a home-country shadow payroll, make sure the Indian PF deduction is reflected there too, so the two records reconcile. Our guide on how an EOR helps with expat employees covers visas and tax.

How does Remunance handle EPF for your foreign hires in India?

Remunance employs foreign nationals on its own Indian entity and registers them as international workers. We file their EPF on full salary, but first check whether a Certificate of Coverage removes the cost. We already support 150+ international clients from 22 countries.

What else do people ask about international worker PF?

Is PF mandatory for foreign nationals in India?

Yes, for EPF-covered establishments, unless the employee is an excluded employee, which in practice means holding a Certificate of Coverage from an SSA country, or a Singapore national contributing at home.

Can a US citizen avoid Indian PF?

No. India has no social security agreement with the USA. A US national on Indian payroll contributes on full salary, whatever their home cover.

Can an international worker withdraw PF on leaving India?

Only in limited cases. Full withdrawal is allowed on retirement after 58, permanent incapacity, or on leaving the job if the member is covered by an SSA.
