What is the 50 percent wage rule in India?

Quick answer: The 50 percent wage rule sits in section 2(y) of the Code on Wages, 2019, in force since 21 November 2025. “Wages” means all pay minus listed exclusions such as HRA, conveyance, employer PF and overtime. If those exclusions exceed half of total remuneration, the excess is added back to wages. Gratuity and retrenchment compensation sit outside the test.

  • The same proviso appears in the wages definition of the Code on Social Security, 2020, so it reaches PF and gratuity.
  • Remuneration in kind counts toward wages only up to 15% of total wages.
  • For equal pay and payment of wages, HRA, conveyance, award pay and overtime count as wages in full.
  • The Centre can notify a percentage other than 50%. None has been notified.

How does the 50% test work?

Add up the excluded items, compare them with half of total pay, and add back any overshoot. That’s the whole test.

The government’s own FAQ example runs like this. Total remuneration is ₹76,000 a month. Basic plus DA is ₹20,000, allowances are ₹40,000, and gratuity plus retrenchment pay is ₹16,000.

Half of ₹76,000 is ₹38,000. The allowances overshoot by ₹2,000, so wages become ₹22,000. Taxmann’s analysis of section 2(y) reproduces the table.

Only the excess is added back. The rule never forces basic salary itself to be 50%.

What does the rule do to a real Pune salary?

It lifts the gratuity base, often sharply. Suppose a legacy offer for a Pune analyst pays ₹1,00,000 a month in total remuneration.

ComponentMonthlyTreatment
Basic₹30,000Wages
Special allowance₹17,000Wages (not excluded)
HRA₹40,000Excluded
Conveyance₹10,000Excluded
Employer PF₹3,000Excluded

Excluded items total ₹53,000, against a cap of ₹50,000. So ₹3,000 is added back, and wages come to ₹50,000.

Under the old Payment of Gratuity Act, allowances sat outside wages, so this analyst’s base was the ₹30,000 basic. Gratuity per year of service was about ₹17,308. On ₹50,000 it is about ₹28,846. That’s 67% more for every completed year.

Where EPF runs on the ₹25,000 ceiling, PF does not move here, because wages exceed the ceiling either way. Pay PF on full wages, though, and it rises with them.

What do the Ministry FAQs add?

Three practical points. The FAQs of 16 March 2026, summarised in SCC Online’s review of the Ministry FAQs, count employer PF and statutory bonus inside the computation and confirm that overtime counts too.

Earlier FAQs, notified on 30 December 2025, keep performance-based incentives and reimbursement-based payments outside wages. They are guidance, so the Code on Wages text wins in any conflict.

The rule is one reason the Labour Codes triggered salary restructuring across India in 2026. Our guide to salary structure in India shows the common fixes, and our overview of labour laws in India gives the wider context.

How does Remunance apply the 50% wage rule for your team?

Remunance tests every salary letter against section 2(y) before the first payroll, then costs gratuity and PF on the corrected wage base. For companies that already employ in India, our compliance management service runs the same test on existing payroll. It is routine work for a team that has hired 1,200+ Indian employees for clients. To find out whether your current structure passes, request a wage-rule audit of your India payroll.

What else do people ask about the new wage definition?

Does the 50% rule mean basic must be 50% of CTC?

No. It caps excluded components at half of total remuneration. Basic can be lower if allowances that count as wages, such as special allowance, fill the gap.

Does the 50% rule reduce take-home salary?

Not by itself. Take-home falls only if the employer restructures pay or pays PF on full wages, which moves money from cash into PF.

Is gratuity included in the 50% calculation?

No. Gratuity and retrenchment compensation sit outside the test, as the government’s ₹76,000 example shows.
